These Terms and Conditions ("Agreement", "Terms") constitute a legally binding contract between you ("User", "Player", "you") and Besarwin ("Company", "we", "us", "our"), the operator of the online gaming and sports betting platform accessible at https://besarwin.cam (the "Platform").

By accessing the Platform, creating an account, depositing funds, or placing any wager, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy and Responsible Gambling Policy, which are incorporated herein by reference.

If you do not agree to any provision of these Terms, you must immediately cease use of the Platform. Continued use of the Platform following any published amendment constitutes acceptance of the revised Terms.

Besarwin operates an English-language platform designed for users in Malaysia. All transactions are denominated in Malaysian Ringgit (MYR) unless otherwise specified. References to currency amounts in these Terms are in MYR unless explicitly stated otherwise.

For the purpose of these Terms, the following definitions apply:

• "Account" means the registered user account created by a Player on the Besarwin Platform, including all associated balance, transaction history, and profile information.
• "Balance" means the total amount of real money funds held in a Player's Account at any given time, denominated in MYR.
• "Bonus Funds" means any promotional credits, free bets, cashback awards, or loyalty rewards credited to an Account that are subject to wagering requirements before conversion to withdrawable cash.
• "Game" means any slot machine, live dealer table, sportsbook market, poker room, lottery-style product, or any other gaming product available on the Platform.
• "KYC" means Know Your Customer verification procedures, including identity and address document checks, required under our compliance obligations.
• "Payment Method" means any bank account, e-wallet, FPX transfer, DuitNow transaction, or cryptocurrency wallet used to fund or withdraw from an Account, including Touch 'n Go eWallet, Boost, GrabPay, Maybank, CIMB, Public Bank, and Hong Leong.
• "Platform" means the Besarwin website, any associated mobile interface, and all Games and services available thereon.
• "RTP" means Return to Player, the theoretical long-term payout percentage of a given Game as certified by its provider.
• "Wagering Requirement" means the number of times a Bonus amount must be wagered on eligible Games before it may be withdrawn, as specified in the applicable promotion's terms.
• "We/Us/Our" refers to Besarwin, the operator of the Platform.

To open and maintain a Besarwin Account, you must meet all of the following eligibility criteria at all times:

3.1 Age Requirement

You must be at least 21 years of age. Besarwin enforces strict age verification during the registration process and reserves the right to request supporting identification documents at any stage. Accounts where the holder is found to be under 21 years of age will be closed without prior notice, and any funds associated with such accounts will be handled in accordance with our compliance procedures. We take our obligations regarding underage gambling seriously and make no exceptions to this requirement.

3.2 Geographic Eligibility

The Platform is designed for use by persons accessing it from jurisdictions where online gaming is permitted under applicable law. It is your sole responsibility to determine whether your use of the Platform is lawful in your jurisdiction. Besarwin does not make representations regarding the legality of online gaming in any specific location outside of the platform's designated operating territories.

3.3 Single Account Policy

Each individual may hold only one (1) registered Account. Registering multiple accounts — whether under your own name, a family member's name, or any other identity — constitutes a material breach of these Terms. Where duplicate accounts are detected, all associated accounts will be suspended and balances will be subject to review. If abuse is confirmed, balances may be forfeited.

3.4 Personal Use Only

Accounts are strictly for personal use. You may not use your Account on behalf of another person, allow another person to access your Account, or operate an Account as part of a syndicate or cooperative arrangement unless explicitly permitted in writing by Besarwin.

3.5 Capacity to Contract

You must have full legal capacity to enter into a binding contract under the laws of your jurisdiction. By accepting these Terms, you confirm that you are not subject to any legal restrictions that would prevent you from entering into this Agreement.

4.1 Registration Information

You must provide accurate, current, and complete information during registration, including your full legal name, date of birth, email address, and mobile number. Providing false, misleading, or incomplete registration information is a breach of these Terms and may result in Account suspension.

4.2 Account Verification (KYC)

Besarwin operates KYC procedures in compliance with applicable anti-money laundering (AML) regulations. You may be required to submit identity verification documents, including but not limited to: a copy of your national identification card (MyKad), passport, proof of residential address, and source-of-funds documentation. Failure to provide requested documentation within a reasonable timeframe may result in withdrawal restrictions or Account suspension.

4.3 Account Security

You are responsible for maintaining the security and confidentiality of your Account credentials. You must not share your password with any third party. You agree to notify Besarwin immediately if you become aware of any unauthorised access to your Account. Besarwin will not be liable for any loss resulting from unauthorised Account access where you have failed to maintain appropriate credential security.

4.4 Right to Refuse Registration

Besarwin reserves the right to refuse, suspend, or close any Account at its sole discretion, including where registration criteria are not met, where suspicious activity is detected, or where applicable compliance requirements cannot be satisfied.

5.1 Accepted Payment Methods

Besarwin accepts deposits and processes withdrawals via the following Payment Methods: FPX bank transfers, DuitNow, Touch 'n Go eWallet, Boost, GrabPay, Maybank Online Banking, CIMB Clicks, Public Bank Online Banking, Hong Leong Connect, and supported cryptocurrencies including Bitcoin (BTC), Ethereum (ETH), and Tether (USDT). Available methods may vary and are subject to change without prior notice.

5.2 Minimum Deposit

The minimum deposit amount is MYR 30, unless a specific promotion specifies a higher threshold. There is no maximum deposit limit for standard accounts, subject to applicable payment provider limits and internal risk controls.

5.3 Own Funds and Third-Party Restrictions

You may only deposit funds from Payment Methods registered in your own name. Third-party deposits — where a payment originates from an account, card, or wallet not belonging to you — are strictly prohibited. Where third-party funding is detected, the deposit will be reversed and the Account may be suspended pending investigation.

5.4 Withdrawal Processing

Withdrawal requests are processed within the timeframes associated with the selected Payment Method. Most verified accounts receive payouts within minutes of request approval. Processing times may be extended where KYC verification is pending, where a withdrawal triggers additional compliance review, or during periods of high platform transaction volume. Besarwin does not guarantee processing within any specific minimum timeframe where verification requirements remain outstanding.

5.5 Withdrawal Conditions

Withdrawals may only be made to Payment Methods previously used to deposit into the Account, in order to comply with AML obligations. Besarwin reserves the right to request additional verification documents before approving any withdrawal. Withdrawals of Bonus Funds are subject to the Wagering Requirements applicable to the relevant promotion.

6.1 General Bonus Terms

All bonuses, promotional offers, cashback programs, birthday rewards, referral bonuses, and loyalty tier rewards offered by Besarwin are subject to their individual terms and conditions, which are communicated at the point of offer. Where a conflict exists between specific promotional terms and this general Agreement, the specific promotional terms prevail.

6.2 Wagering Requirements

Bonus Funds are not immediately withdrawable. They must be wagered a specified number of times (the Wagering Requirement) on eligible Games before conversion to withdrawable cash. Wagering Requirements and eligible Game categories are specified in each promotion's individual terms. As a general guide, wagers on Live Dealer games may contribute at a lower percentage toward Wagering Requirements than wagers on Slots — specific contribution rates are published with each promotion.

6.3 Bonus Validity

All bonuses are subject to expiry. Bonus Funds and associated Wagering Requirements that are not completed within the validity period will expire and be removed from the Account. Expired bonuses cannot be reinstated.

6.4 Anti-Abuse Policy

Besarwin reserves the right to void bonuses and associated winnings, and to suspend Accounts, where it reasonably suspects bonus abuse. This includes, but is not limited to: placing low-risk or hedged wagers solely to meet Wagering Requirements, exploiting system errors or technical glitches, or coordinating with other players to unlock bonuses across multiple accounts.

6.5 Loyalty Program

Besarwin operates a tiered loyalty program (Bronze, Silver, Gold) under which Players earn points on eligible wagers. Points, tier benefits, cashback rates, and birthday bonus values are determined by Besarwin at its discretion and may be amended upon reasonable notice. Tier status is reviewed on a monthly basis. Loyalty points and tier status have no cash value and cannot be transferred between accounts.

7.1 Acceptance of Wagers

All wagers placed on the Besarwin sportsbook and casino Games are subject to the specific rules governing the relevant market, event, or Game type. Besarwin reserves the right to refuse, limit, or void any wager at its discretion, including where a wager is placed in error, where market odds have been published incorrectly, or where circumstances render settlement undeterminable.

7.2 Game Fairness and RNG

All Besarwin casino Games use certified Random Number Generators (RNG) to ensure fair and unpredictable outcomes. Published RTP figures are accurate to the best of our knowledge and are sourced from certified game providers. Besarwin does not manipulate Game outcomes.

7.3 Sportsbook Markets

Sports betting markets, including Liga Super Malaysia, English Premier League (EPL), UEFA competitions, UFC, Formula 1, and other events, are settled in accordance with official results from recognised governing bodies. Settlement rules for individual sports and market types (including Asian Handicap, Over/Under, and live in-play markets) are published within the Platform's help and rules documentation.

7.4 Malfunctions and Errors

In the event of a technical malfunction, software error, or communication failure that affects the integrity of a Game or betting market, Besarwin reserves the right to void affected wagers and return stakes. Winnings generated as a result of a malfunction or manifest error are not payable. Besarwin will use reasonable efforts to resolve technical issues promptly and to communicate outcomes to affected Players.

The following conduct is strictly prohibited on the Besarwin Platform. Engaging in any of the below may result in immediate Account suspension, forfeiture of balances, and reporting to relevant law enforcement or regulatory bodies:

• Using automated software, bots, scripts, artificial intelligence tools, or any non-human method to interact with the Platform or place wagers
• Opening or operating multiple Accounts for the same individual, whether under the same or different identity details
• Using or attempting to use payment methods belonging to third parties
• Engaging in money laundering, structuring transactions to avoid reporting thresholds, or using the Platform for any financial crime purpose
• Colluding with other Players in poker rooms or other competitive Game formats
• Providing false, inaccurate, or misleading information during registration, KYC, or in communications with Besarwin support staff
• Exploiting technical errors, software glitches, or pricing anomalies in sportsbook markets to generate artificial profit
• Engaging in, facilitating, or having knowledge of match-fixing or sports manipulation in connection with any betting market on the Platform
• Threatening, harassing, or abusing Besarwin staff or other Platform users
• Attempting to reverse-engineer, copy, scrape, or reproduce any part of the Platform's software, content, or intellectual property

Besarwin is committed to promoting responsible gambling among all Platform users. We provide a suite of self-management tools designed to help Players maintain control over their gambling activity:

• Deposit Limits: Players may set daily, weekly, or monthly deposit caps. Limits are applied immediately upon request and cannot be increased within a 7-day cooling-off period.
• Session Time-Outs: Players may apply a temporary suspension to their Account for a period ranging from 24 hours to 6 weeks. During a time-out, no deposits or wagers may be placed.
• Self-Exclusion: Players seeking a longer-term break may apply for permanent self-exclusion. Self-exclusion requests are processed within 24 hours. Self-excluded Players may not open a new Account on the Platform.
• Loss Limits: Players may set a maximum net loss threshold for a defined period. Once the threshold is reached, betting is automatically suspended until the period resets.
• Reality Checks: Optional periodic notifications displaying session duration and net wagering position are available through Account settings.

All intellectual property rights in the Platform, including but not limited to the Besarwin brand, logo, website design, software architecture, Game interfaces, written content, graphics, and promotional materials, are owned by or licensed to Besarwin. No User is granted any ownership interest in any Platform intellectual property by virtue of Account registration or use.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial gaming purposes only. This licence does not include the right to copy, reproduce, distribute, publicly display, reverse-engineer, or create derivative works of any Platform content.

Any unauthorised use of Platform content, trademarks, or software constitutes a breach of these Terms and may give rise to civil or criminal liability.

To the maximum extent permitted by applicable law, Besarwin's total aggregate liability to any User in connection with the Platform — whether arising in contract, tort, negligence, or otherwise — shall not exceed the total net deposits made by that User during the 30-day period immediately preceding the relevant claim.

Besarwin shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from Platform use, including but not limited to:

• Loss of profits, winnings, or gaming opportunity resulting from technical downtime or interruption of service
• Delays in deposit or withdrawal processing attributable to third-party payment providers, including FPX, DuitNow, e-wallet operators, or banking institutions
• Data loss or breach resulting from circumstances beyond Besarwin's reasonable control
• Errors in Game outcomes arising from certified RNG systems operating within their designed parameters
• Any loss resulting from a User's failure to maintain Account credential security

Nothing in these Terms shall limit Besarwin's liability for fraud, wilful misconduct, or where liability cannot be excluded by applicable law.

12.1 Suspension by Besarwin

Besarwin reserves the right to suspend or close any Account, with or without prior notice, where: these Terms have been breached; there are reasonable grounds to suspect fraudulent, abusive, or unlawful activity; applicable KYC or AML requirements cannot be met; or the Platform determines, at its sole discretion, that continued provision of services to the Account holder is not appropriate.

12.2 Balance Treatment on Closure

Where an Account is closed due to a confirmed breach of these Terms, Besarwin reserves the right to forfeit any balance attributable to the breach, including Bonus Funds and any winnings generated through prohibited conduct. Real money balances not connected to a confirmed breach will be returned to the Account holder via the original Payment Method following completion of any required compliance review.

12.3 Voluntary Account Closure

Players wishing to close their Account voluntarily may do so by contacting Besarwin's support team. Any remaining verified real money balance will be processed for withdrawal to the Account holder's registered Payment Method. Voluntary closure requests will be processed within 5 business days.

Besarwin reserves the right to amend these Terms at any time. Where changes are material, we will provide reasonable notice to registered Account holders via email or a prominent notification on the Platform prior to the effective date of the amendment.

Your continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree with a proposed change, you must cease use of the Platform and may request Account closure prior to the effective date.

Minor amendments — such as corrections to typographical errors or clarifications that do not alter the substantive meaning of any clause — may be made without prior notice.

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with applicable international gaming regulations and the laws of the jurisdiction in which Besarwin is licensed to operate.

In the event of any dispute between you and Besarwin arising from the use of the Platform, both parties agree to seek resolution through the following process:

1. Informal Resolution: Contact Besarwin's support team at [email protected] with a written description of the dispute. We will endeavour to respond substantively within 5 business days.
2. Formal Complaint: If informal resolution is unsuccessful, you may submit a formal written complaint. Besarwin's compliance team will investigate and respond within 20 business days.
3. External Dispute Resolution: Where an internal resolution cannot be reached, the matter may be referred to an independent dispute resolution body as specified by our operating licence conditions.

You agree not to initiate any legal proceedings without first exhausting the above dispute resolution steps. Nothing in this clause limits either party's right to seek urgent injunctive relief where circumstances warrant it.
